| | | | | | | | Requested Motion: Motion to approve FY2021-2022 Collective Bargaining Memorandum of Agreement between The City of Crystal River and the Florida Carpenters Regional Council, Local 2038 of the United Brotherhood of Carpenters and Joiners of America to amend the current collective bargaining agreement effective October 1, 2021 through September 30, 2022 agreed between both parties.

| | | | | | | | Summary: Several Job Classifications in the City form a bargaining unit and are represented by Florida Carpenters Regional Council, Local 2038. Per Article 26 of the union contract, Duration, Modification and Termination of the Union contract, either the City or the Union have the opportunity to open Article 23 Wages and up to two (2) additional articles of the Union agreement per contract year by sending written notice to the other party no earlier than January 1st and no later than May 1st each contract year. Both parties have met three (3) times since June 30, 2021 to discuss several items ranging from wages to employee job related incentives/enhancements. While management is not always agreeable to all requests presented by the Union, we strive to come to a resolution that is reasonable, fair and within the City’s budget constraints. The bargaining unit members voted for the requested amendments to the contract on Thursday, September 30, 2021.
Amendment #1 – Article 10.2 – Discharge and Discipline. Management desired to modify time limit 10 calendar days for action and add provision for notice if an ongoing investigation will take in excess of 10 calendar days.
Amendment #2 – Article 23 – Wages and Benefits. The Union requested a 10% hourly rate increase for all union eligible employees. Due to the change with the legislative Amendment 2, Management declined this request. Management proposed a $1.00 an hour or 3% increase, whichever is greater, for both union and non union employees. Both parties agreed with Management’s proposal.
The Union requested a few other items as noted below; however, following discussion with the City no changes were agreed.
• Article 12. The Union wanted to add President’s Day as a paid holiday. After reviewing consistency with other local municipalities, it was decided not to move forward with this addition.
• Article 16. The Union proposed an update to 16.11 allowing employees on FMLA to reserve up to 40 hours of vacation leave to be taken at a later date. The Union also proposed an update to 16.12 affording employees with sick leave in excess of 40 hours an opportunity to donate to any other employee in the city. Management denied both requests but is agreed to work on a sick leave donation policy.
All above amendments to the current Collective Bargaining Agreement covering the period of 10/1/2019 – 9/30/2022 will be effective 10/1/2021 –9/30/2022.
Staff Recommendation: Management recommends approval of FY2021-2022 Collective Bargaining Memorandum of Agreement between The City of Crystal River and the Florida Carpenters Regional Council, Local 2038 of the United Brotherhood of Carpenters and Joiners of America effective October 1, 2021 through September 30, 2022. The changes are consistent with the Council’s Executive Session.
