Staff is requesting adoption of Master Capital Project and Service Assessment Ordinance No. 21-O-05 which is a procedural ordinance that sets up the process for the City to impose both capital and service special assessments in the future in accordance with the City’s home rule authority pursuant to Article VIII, Section 2, Florida Constitution, and Section 166.021, Florida Statutes. This ordinance does not actually impose any special assessments. Instead, it authorizes both capital and service assessments to be imposed pursuant to a two-step process, designed to be consistent with the Uniform Method of Collection (tax bill) in Section 197.3632, Florida Statutes.
The two-step process consists of an initial assessment resolution and a final assessment resolution. The initial assessment resolution would determine the assessment area, the assessable cost, the apportionment methodology, the maximum assessment rates, directs the statutorily required notice, and set a final public hearing on the proposed assessments. After the provision of the statutorily required 20-day mailed and published notices, the final assessment resolution would be considered at a public hearing. The final assessment resolution would confirm or modify the initial assessment resolution, establish the final assessment rates (which can be lower than the maximum rates, but not higher) and then approve the assessment roll. The ordinance also contains provisions for the continued implementation of a previously adopted assessment program in subsequent fiscal years, authorizes the city to offer hardship assistance and property exemptions on a program-by-program basis, and authorizes the City to issue special assessment debt obligations by subsequent resolution if desired.
